1. Introduction
1.1 These terms and conditions govern the use of services provided by View 3sixty Ltd (referred to as “we,” “us,” or “our”). By accessing or using our services, you agree to comply with these terms and conditions.
1.2 We provide virtual tours and photography services for various purposes, including but not limited to businesses, educational institutions, and individual clients.
2. Services Provided
2.1 Our services include the creation of virtual tours, professional photography, 360-degree imagery, and related services, as agreed upon in the service contract.
2.2 The specific details of the services, including pricing, number of scenes, features, and timelines, will be outlined in the individual service agreement or quote provided to the client.
3. Payment Terms
3.1 Payment for our services will be due as outlined in the service agreement or invoice. Unless otherwise stated, this is 30 days from date of invoice.
3.2 Payments can be made via bank transfer only.
3.3 Late payments may incur a 10% late fee for every 30 days the payment is overdue.
3.4 Any changes to the agreed services after a contract has been signed may result in additional charges.
4. Client Responsibilities
4.1 The client is responsible for ensuring that all necessary permissions, consents, and licenses are obtained for any property or subjects being photographed or included in the virtual tour. This excludes aerial imaging, whereby our team will obtain all necessary approvals prior to the drone flight.
4.2 The client is responsible for ensuring that the location is accessible and ready for the photography/filming sessions on the agreed dates.
4.3 Any changes to the project scope or schedule must be communicated to us in advance. We will make reasonable efforts to accommodate changes, but may charge additional fees for changes outside the original scope.
5. Copyright and Usage Rights
5.1 All photos, videos, and virtual tours produced by us remain our intellectual property unless otherwise agreed.
5.2 Upon full payment, the client is granted a non-exclusive, non-transferable license to use the virtual tours, photographs, and related content for the agreed purposes as outlined in the service agreement.
5.3 The client may not sell, license, or distribute the materials without prior written consent from us.
6. Delivery and Timelines
6.1 We will make reasonable efforts to complete and deliver the services within the timeline specified in the service agreement.
6.2 Delays may occur due to factors outside of our control, such as adverse weather conditions, technical issues, or client-related delays. We will notify the client as soon as possible if such delays occur.
7. Cancellation and Refunds
7.1 Cancellations must be made in writing at least 14 days before the scheduled service date.
7.2 Cancellations made after this time frame may be subject to a cancellation fee or partial refund, depending on the stage of the project.
8. Limitation of Liability
8.1 We will not be held liable for any indirect, incidental, or consequential damages arising from the use of our services.
8.2 Our liability for any claim arising from our services is limited to the amount paid by the client for the specific service in question.
9. Confidentiality
9.1 We agree to keep any confidential information shared by the client during the course of the project strictly confidential and will not disclose it to any third party without prior consent, unless required by law.
10. Force Majeure
10.1 We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of nature, government restrictions, or other events outside our control.
11. Governing Law
11.1 These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom.
11.2 Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of the United Kingdom.
12. Amendments
12.1 We reserve the right to amend these terms and conditions at any time. Any changes will be posted on our website, and the revised terms will apply to all future contracts unless otherwise agreed upon in writing.
